SPSB application against Felda, FIC dismissed

KUALA LUMPUR: The Kuala Lumpur High Court has on July 23 dismissed summary judgment application by Synergy Promenade Sdn Bhd (SPSB) against Federal Land Development Authority (Felda) and Felda Investment Corporation Sdn Bhd (FIC).

SPSB had commenced a legal action against Felda and FIC for specific performance related to a Development Agreement in June 2014 between SPSB and FIC.

In essence, SPSB sought an order against Felda and FIC to deliver to it vacant possession of 23 parcels of land located along Jalan Semarak KL which belong to Felda.

“The Kuala Lumpur High Court dismissed SPSB’s application to enter summary judgment against Felda and FIC and awarded cost of RM10,000 to Felda and FIC,” Felda said today.

“Among others, the court found that the validity of the agreement was doubtful, as the approval of the Minister in charge of Felda was not obtained prior to the execution of the Development Agreement.””

Felda added that the minister’s approval was a requirement imposed by the law, namely s.3(3)(c) Land Development Act 1956.

Felda and FIC were represented by Kumar Kanagasingam, Mong Chung Seng and Michele Yee Phui Hwa of Messrs. Lee Hishammuddin Allen & Gledhill.
